Rights of Use

The image/video material can be used exclusively by the client (Simple Right of Use). Technical transfer to service providers (e.g. Google Ads, Meta) for display on behalf of the client is permitted, provided the client remains the sole beneficiary. Transfer or sale to third parties for their own use (Third-party commercial usage) is NOT included. This also applies to free image/video modification. Extended rights can be purchased for an additional charge.

Raw Material

Unless otherwise agreed, only the defined end products will be handed over. The release of raw footage is not part of the scope of services and can be booked separately for an additional charge.

Attribution

'Photo: VideoMetrixs' or 'Video: VideoMetrixs' must be stated in the photo credit on the website (or other media). Waiver possible for an additional charge.

Self-Promotion

VideoMetrixs is entitled to use the material for self-promotion and to cite the customer as a reference.

Revision Loops

One revision loop is included. All further adjustments will be charged additionally.

Concepts

Elaborated concepts and scripts are protected by copyright and may not be used or implemented with other companies without consent (Penalty for violation: Cost of concept creation).

Storyboard

If a storyboard is part of the project, five revision loops are included. After approval, no changes without additional costs.

Third Party Rights

The client is liable for all third-party rights (persons, locations, brands) and indemnifies VideoMetrixs against claims.

Payment

30% deposit upon placing the order. Balance 30 days after final invoice.

Cancellation

Free of charge in case of postponement (within 1 year). Otherwise: Up to 14 days before 30%, up to 4 days 60%, thereafter 75%. Third-party costs (models, etc.) are charged at 100%.

Force Majeure (Protection)

Should the event/shoot be cancelled or aborted due to Force Majeure (weather, epidemic, etc.), all expenses and costs incurred up to that point (incl. hardware/software) must be paid.

Videographer Default

In case of default of the videographer (illness/Force Majeure), the deposit will be refunded. Further claims are excluded.

Duty of Care

Professional equipment is used. No damages can be claimed in case of influence of uncontrollable factors (weather, technical defect, theft, data loss due to SEU).

Time-Lapse Risk

With unattended equipment, the client bears the full risk for theft/damage from installation onwards and is liable for the replacement value.

Weather Risk

In case of unacceptable lighting conditions, the shoot can be aborted by mutual agreement. Additional costs for repetition are borne by the client.

Permits & Liability

The client bears responsibility for filming in restricted areas (e.g., nature parks, no-fly zones) or people without releases. If filming occurs at the client's request without a permit, the client indemnifies VideoMetrixs against all fines and legal consequences.

Music/Voice

Standard license online only. TV/Netflix or Paid Ads (Voice Over) require Buy-Out/Additional License.

Trending Audio

The use of copyrighted music (e.g., for Social Media Trends) is at the client's sole risk regarding platform bans or financial claims from rights holders.

Agencies

Agency and client receive simple right of use. Mention '📹@franz.metrixs' (Instagram) or 'videometrixs.com' mandatory. Agency may use material for self-promotion. No transfer of raw material. The cooperation is treated confidentially; internal information remains protected.

CGI/Retouching

Not included as standard. Billing according to expenditure.

Timeframe

Deadlines must be communicated before placing the order.

Expenses & External Costs

Expenses not included in the offer (e.g., parking fees, tolls, cable car tickets, entrance fees) will be charged to the client.

1. Reservation and payment

The date is considered firmly reserved once the deposit of 30% of the package price has been received. The remaining balance is due within 30 days of the final invoice.

2. Postponement and cancellation

A one-time postponement of the date within 12 months is free of charge, subject to availability. Any further postponement counts as a new booking. In the event of cancellation, the 30% deposit is retained as compensation. For cancellations within 30 days of the date, 50% of the package price is due. Third-party costs already incurred are charged at 100% in any case.

3. Weather clause (elopements and weather-dependent outdoor shoots)

At booking, a shooting day and an alternative day (ideally within two weeks) are agreed. The decision on a postponement is made together on the evening before, based on the weather forecast. Moving to the alternative day is free of charge. If both dates are not possible due to weather, a new date is agreed within 3 months, subject to availability. If the clients decide to proceed despite a weather risk communicated by VideoMetrixs, aborted or unusable shoots are charged (travel and time on site).

4. Drone footage

Aerial footage is captured exclusively where legally and locally permitted (e.g. no-fly zones, nature parks, helicopter corridors). If a drone flight is not possible, coverage is provided with ground equipment; this does not entitle the client to any price reduction.

5. Illness and incapacity

In the event of illness, VideoMetrixs will make every reasonable effort to arrange a qualified replacement. There is no legal entitlement to a replacement. If no replacement can be arranged, the deposit is refunded in full; further claims are excluded.

6. Format and delivery

Wedding films are produced and delivered in 4K in 16:9 format, unless agreed otherwise in writing before the wedding. Vertical 9:16 versions are not included and can be booked as an add-on; they are cropped from the 16:9 original. Delivery takes place as a 4K digital download within 1 to 3 months of the date, with one revision round included. Raw footage is not handed over; only the finished films are delivered.

7. Meal and positioning

For full-day coverage, the clients provide a seat and a meal. The placement is up to the clients, but should allow a quick reaction to key moments (speeches, dance, surprises).

8. Credit

For private wedding and elopement films, a credit line is not mandatory but appreciated (e.g. a mention of VideoMetrixs or a tag of @franz.metrixs on Instagram).

Scope of Services & Maintenance

The basic offer exclusively covers the design and development of the website. Hosting, domain management, and ongoing maintenance are not included unless explicitly agreed upon in writing. Fixing errors caused by the client or third parties after the final handover is not part of the basic offer and will be billed separately.

Client Cooperation & Revision Rounds

The client must provide all necessary texts and images, which will be implemented in the first phase. The offer includes two (2) free revision rounds for design and content adjustments. From the third revision round onwards, as well as for any additional changes outside the original scope, services will be invoiced separately based on the required effort.

Commissioning & Specifications

To achieve the best possible results in image enhancement, it is highly recommended to provide clear and precise instructions with the order. Without specific guidelines, a general aesthetic enhancement process will be applied. Tiered package pricing is available for larger order volumes.

Process, Selection & Additional Services

For each submitted image, the client receives four (4) versions created via generative technologies to choose from. The client selects one (1) final image, which is delivered in 2K resolution by default. Purchasing additional versions from the selection or requesting a second enhancement round with four new drafts is possible for an additional fee.

By placing an order verbally or in writing, these terms and conditions are accepted.
